Generally speaking, a party wall is a wall which forms part of a building and stands on lands of different owners.
If you’re planning to undertake any construction work that could potentially affect a party wall, it’s a legal requirement to notify your neighbours and obtain their consent. Failure to issue the required party wall notice on all “qualifying” Adjoining Owners could result in injunctive proceedings being issued and legal cost being incurred.
Our surveyors would undertake an initial review of your proposed works and determine what party wall notices are legally required to be served. Subsequently we would then prepare and serve the necessary notices on all Adjoining Owners, outlining the proposed works caught under the Act, providing them an opportunity to raise any concerns or objections.
In the event any Adjoining Owner dissents from the proposed works, in accordance with the Party Wall etc Act 1996, Party Wall Surveyors are formally appointed for each party, who then resolve the dispute between the parties using the mechanisms of the Act.
